Terms of Use
What you may and may not do with this website, our whitepapers and our free tools — and where this page stops and a signed agreement begins.
Review status. This document describes our actual practice and is published in good faith. It has not yet been reviewed by external counsel. Where it matters commercially — a contract, a regulatory filing, a procurement questionnaire — ask us for the executed agreement rather than relying on this page.

What these terms cover
These terms govern your use of this website and the material published on it: the pages, the whitepapers, the insight articles, the enquiry form and the two free self-serve tools. By using the site, you accept them. If you do not accept them, please stop using the site.
These terms do not govern consulting work. Every engagement with us runs on a document somebody signed — a proposal, a statement of work, a master services agreement, an NDA, or some combination of those. Where anything in a signed engagement document differs from this page, the signed document prevails for that engagement. Nothing on this page varies it, adds to it or limits it.
We are Avisha Global Technologies Pvt Ltd, a company operating in India. On this page, “we”, “us” and “our” mean that company; “you” means whoever is using the site.
Permitted use of this site
This is an information and marketing site. There is no account to create, nothing to log in to, nothing to buy, and no way for visitors to post content. Using it is simple: read a page, download a whitepaper, run a tool, send us an enquiry.
What we ask you not to do:
- Scrape, bulk-download or systematically harvest the site, or crawl it in a way that degrades it for other people.
- Probe, scan or test the security of this site or the systems behind it without our written permission. If you have already found something, tell us at [email protected] — we would far rather hear from you than not.
- Send us, through the enquiry form, anything false or unlawful, anyone else’s confidential information, or personal data about a third party that you have no basis to share.
- Use the site or our published material to build, train or market a competing service, or to resell our material.
- Strip out attribution, copyright notices, publication dates or the scope statements that give our material its meaning.
We may restrict access to the site for anyone doing these things. That is the only enforcement mechanism a site like this has.
Intellectual property, and what you may do with a whitepaper
The text, structure, design, diagrams, whitepapers, insight articles, assessment methodology descriptions, the Avisha Global name and the Avisha Trust Seal mark are our intellectual property or are licensed to us. Publishing them openly does not place them in the public domain, and reading the site grants you no licence to our trademarks or brand name.
Our whitepapers are published ungated: no form, no email address, no sales call in exchange. We did that on purpose, and we would rather they circulated than sat behind a gate. So, to be explicit about it:
You may
- Read them, save a copy and print them.
- Quote from them, with attribution to Avisha Global and a link or citation.
- Cite them in your own internal, regulatory or academic work.
- Circulate them inside your organisation — to your board, your auditors, your security team, your counsel.
- Name us in the ordinary way in a vendor list, a procurement document or an internal paper. That needs no permission.
You may not
- Republish them, in whole or in substantial part, under your own or anyone else’s name.
- Sell them, put them behind a paywall, or bundle them into a paid course, tool-kit or subscription.
- Present our analysis to a client as your firm’s own work product.
- Alter a whitepaper and keep our name on it.
If what you want sits between those two lists — a reprint, a translation, a co-branded version for your members or your industry body — ask us. We usually say yes, and it takes one email.
The free self-serve tools
Two tools on this site — the DPDP gap assessment and the DPDP readiness calculator — run entirely in your browser. Your answers are never transmitted to us and are not stored on any server. We never see them, and we could not produce them if someone asked us to. That is a design decision, and the Cookie Policy explains how to verify it yourself.
What the output is: an informational indication of where your organisation’s practice is likely to be strong or weak, and which area is probably worth looking at first, based solely on the answers you gave.
What the output is not: legal advice, a legal opinion, an audit, a compliance certification, or evidence that will satisfy a regulator, auditor, insurer or customer. A score tells you where to look. It cannot tell you that you comply, and it does not claim to.
The output is only ever as good as the answers given. Answer aspirationally and you will get a flattering number that means nothing. Treat the result as a prompt for internal discussion, and take advice from your own counsel before making any decision that carries legal or financial consequence.
Whitepapers and insights are information, not advice
Everything we publish here is general information about data-protection law, security and AI practice. It is not legal advice, it is not a legal opinion, and it is not a substitute for advice from your own counsel applied to your own facts.
The DPDP Act and the Rules under it are phasing in. Obligations, timelines, prescribed forms and the detail of what regulators expect will keep moving for some time. A whitepaper or article that was accurate on the day we published it may be out of date by the time you read it, and we do not promise to revise every page as the position shifts. Check the date on the document, and confirm the current position with counsel before you rely on it for a filing, a contract or a board decision.
The Avisha Trust Seal — what it is and is not
The Avisha Trust Seal is our own assessment mark. It is not a government certification, a statutory approval, an accredited standard, or a legal certification of compliance with any law or regulation. We say that on the Seal’s own page too, and we would rather repeat it than let a buyer assume otherwise.
What it does mean is narrow and specific: an organisation completed Avisha Global’s own assessment methodology, within a defined scope, at a point in time, and the Seal carries a stated validity period after which re-assessment is required. It is evidence that an assessment happened, what it covered and when — nothing further.
If you are relying on another organisation’s Seal as a buyer: read the scope statement issued with it, check that it is still within its validity period, and ask them for the underlying assessment. If your regulator, customer or insurer requires an accredited certification, the Seal is not that, and we will tell you so rather than let the distinction blur.
Displaying the Seal mark requires a current assessment and our permission. Using it without one, after it has lapsed, or outside its stated scope is misuse of our mark, and we will ask for it to be taken down.
Using this site creates no professional relationship
Reading a page, downloading a whitepaper, running a tool or sending an enquiry does not make us your consultants, advisers, auditors or lawyers. We are not a law firm and we do not practise law. Where an engagement needs a legal opinion, that comes from your counsel or from counsel we work alongside.
A professional relationship with us begins only when both sides have signed an engagement document that says so. Until then, please do not send confidential, privileged or regulated material through the enquiry form. Describe the shape of the problem; we will put an NDA in place before you send the detail.
Links to other websites
We link out to statutes, regulator notices, standards bodies, news coverage and vendor documentation, because a claim with a source behind it is worth more than one without. Those sites are not ours. We do not control them, we do not endorse everything on them, and we are not responsible for their content, their accuracy or how they handle your data. Once you follow a link, that site’s terms and privacy practices apply instead of ours.
A link is not a partnership, a reseller relationship or an endorsement unless we say in words that it is.
Availability of the site
This is a marketing site, not a service you should build a process around. We make no uptime commitment for it. It may be unavailable because of maintenance, hosting or network problems, a change we are making, or something outside our control — with or without notice — and we are not liable for that unavailability or for anything you could not do while it lasted.
Availability, support and response commitments for real engagements live in the relevant signed agreement. Nothing on this page sets them, and nothing on this page should be read as a service level.
Accuracy, and our right to change what is published
We try to be accurate and specific, and to avoid the vagueness that makes consulting websites interchangeable. We do not publish invented case studies, borrowed logos or numbers we cannot stand behind. Even so, a page can contain an error, an omission, or a statement that events have overtaken.
We may change, correct, move or withdraw any page, whitepaper or tool at any time, without notice. We do not guarantee that a page you saw once will still be there, or that a whitepaper will stay available in the same form or at the same address. If something here looks wrong, tell us at [email protected] — we will check it, and correct it if it is wrong.
Limitation of liability
Plainly stated: use the information on this site at your own judgement and risk.
The site and everything on it are provided as they are, without warranty of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of, or reliance on, this website, its whitepapers, its insight articles or its free tools. That includes indirect and consequential loss, loss of profit, loss of data, business interruption, regulatory penalties and the cost of remedial work.
Two limits on that limitation, because a term you cannot defend is not worth writing:
- Nothing here excludes or restricts liability that cannot lawfully be excluded or restricted — including liability for fraud or fraudulent misrepresentation, and for death or personal injury caused by negligence.
- This clause concerns the website only. Our liability for consulting work is dealt with in that engagement’s signed agreement and is neither capped nor modified by this page.
Indemnity
If you use this site or our published material in breach of these terms, and that causes a third-party claim against us, you will cover the reasonable losses, costs and legal fees we incur as a result. We will tell you promptly if such a claim arises and give you a fair opportunity to take it over or settle it. That is the whole of the indemnity.
Governing law and jurisdiction
These terms, and any dispute about this website or the material published on it, are governed by the laws of India.
The courts of the city named below have exclusive jurisdiction over any such dispute. To be confirmed: the city whose courts have exclusive jurisdiction — to be set to the company’s registered office location before this page is published.
Disputes arising under a signed engagement agreement are governed by the law and the dispute-resolution clause in that agreement, not by this one.
Changes to these terms
We will revise this page as the site changes — a new tool, a new kind of publication, a correction, or a clause counsel asks us to tighten. The “last updated” date at the top tells you when it last moved.
There is no mechanism here to notify you individually: no accounts, no mailing list attached to this page. The version published at the time you use the site is the version that applies, so if these terms matter to your organisation, keep a dated copy of the one you reviewed. If you are reviewing this as part of vendor onboarding, ask us for the engagement terms instead — those are the documents that will actually bind us to you.
